La Unión Tepito leader “El Lunares” released after defect in detention

A federal judge determined on Saturday not to bind over to trial the alleged leader of La Unión Tepito Óscar Andrés “F,” known as “ El Lunares ” and his two accomplices, arrested on January 31 and ordered their immediate release from the maximum-security prison they were being held at.

In an audience that lasted for 13 hours, Beatriz Moguel , judge of the Federal Criminal Justice Center of the Reclusorio Oriente established that there are “unsurpassed and unsurpassable contradictions ” about the time and place circumstances in which the alleged criminals were arrested on January 31 during a joint operation between the Navy and Mexico City’s police in Hidalgo.

“I cannot grant the binding over to trial demanded by the prosecutors for there is a lack of evidence to bind to trial,” determined the judge.
