A federal court ordered the admission of the evidence presented by Kate del Castillo with which she seeks to prove that she has impeached the negative of Mexico Attorney General’s Office (FGR) to give her copies to justify her claim for Patrimonial Responsibility against the Mexican Government.
The First Collegiate Criminal Court of Mexico City ordered a federal judge to accept the evidence of the actress in an amparo trial she presented against the deal of April 11th, 2019 in which the FGR denied her request for certified copies of the preliminary investigation PGR/SEIDO/UEIDCS/523/2015 .
Kate del Castillo seeks to add copies of the preliminary investigation to the administrative lawsuit in which she demanded the payment of a compensation of MXN $60 million under the consideration the extinct PGR damaged her honor by linking her to the leader of the Sinaloa cartel “El Chapo” Guzmán.
After the negative of the FGR, the actress submitted an application for amparo before the Third District Criminal Judge in which she offered as supervening evidence the certified copy of the deal of April 11th and of the different amparos with which she has impeached it, for she asserts that with this determination, the FGR prevents her from exercising her right to a defense in the claim of Patrimonial Responsibility she presented against the Government.
The judge discarded the evidence offered by the actress who presented a motion of reconsideration of dismissal of appeal in which the First Collegiate Criminal Court of Mexico City considered her arguments well-founded.
“The wrongful acts of the petitioner are founded and sufficient to abrogate the part of the contested decision, although for it the cause of action is addressed, and by resuming jurisdiction, based on article 103 of the Amparo Law , it is determined to accept the documents offered by the petitioner because what she pretends to prove is that the deal of March 28th, 2019 , which underpins the claimed act, was subject to litigation by virtue of several writs of amparo ,” ordered the magistrates.
The claim for Patrimonial Responsibility in which Kate del Castillo demands the payment of MXN $60 million, derived from the preliminary investigation PGR/SEIDO/UEIDCS/523/2015 in which she was investigated for concealment and illegally obtained resources, derived from her meeting with drug-trafficker Joaquín “El Chapo” Guzmán.
The investigation was filed since March 21st, 2017 , for the then PGR determined an entry of nolle prosequi.
Hence, the actress offered the certified copies of such file as evidence to prove that the Mexican Government had committed Patrimonial Responsibility, for she considers the extinct PGR leaked information related to the investigation and acted irregularly causing her damage and affectations.
